Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the products and services offered by Fluidify ("we", "us", or "our"), including the Fluidify website at fluidify.ai and the Regen software. By accessing or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our services.

1. About Fluidify

Fluidify is a software company offering AI-native operations and observability tools. Our primary product, Regen, is an open-source, self-hosted incident management platform licensed under the AGPLv3 licence. We may offer additional paid or managed services ("Pro" or "Enterprise") in the future, which will be subject to separate agreements at that time.

2. Open-Source Software

The core Regen software is free and open-source, licensed under the GNU Affero General Public License v3.0 (AGPLv3). Your use of the self-hosted Regen software is governed by that licence, not these Terms. These Terms apply to your use of:

  • The Fluidify website (fluidify.ai)
  • Any managed or cloud-hosted services we may offer
  • Any APIs or SDKs provided by Fluidify outside the OSS codebase

The AGPLv3 licence is available at gnu.org/licenses/agpl-3.0.html.

3. Acceptable Use

You agree not to use Fluidify services to:

  • Violate any applicable law or regulation
  • Infringe any intellectual property or privacy rights of any person
  • Distribute malware, spam, or harmful content
  • Attempt to gain unauthorised access to any system or data
  • Interfere with or disrupt the integrity or performance of our services
  • Engage in any conduct that is defamatory, abusive, or harmful to others

We reserve the right to suspend or terminate access to our services for violations of this section, without prior notice.

4. Intellectual Property

The Fluidify name, logo, and website content (excluding open-source code) are our intellectual property. You may not use our name, logo, or branding without prior written permission. The open-source Regen codebase is licensed under AGPLv3 — your rights to that code are defined by that licence.

5. Disclaimer of Warranties

Our services, including the website and any software, are provided "as is" and "as available", without warranty of any kind. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Note on self-hosted software: When you run Regen on your own infrastructure, you are responsible for its operation, security, and data. Fluidify has no visibility into or control over self-hosted deployments.

6. Limitation of Liability

To the maximum extent permitted by law, Fluidify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms shall not exceed the amount you have paid to us in the twelve months preceding the claim, or INR 1,000, whichever is greater.

7. Third-Party Links and Services

Our website and documentation may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of those sites. Links do not constitute an endorsement.

8. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you.

9. Termination

We may suspend or terminate your access to our services at any time, with or without cause or notice. You may stop using our services at any time. Sections that by their nature should survive termination (including limitations of liability, disclaimers, and governing law) will survive.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, and the Information Technology Act, 2000, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, India. We encourage you to contact us first at contact@fluidify.ai to resolve any dispute informally before initiating formal proceedings.
